Terms and Conditions
The property known as Moulin le Ponto ("the Property") is offered for holiday rental subject to confirmation by Moulin Le Ponto ("the Owner") to the renter ("the Client").
These terms and conditions detail the agreement of temporary property rental between the Client and the Owner.
The Client is over 18 years of age.
Where the Client is two or more persons, each Client will be liable for all sums due under this agreement and not just a proportionate part.
The Client acknowledges that the Property is not an official tourist structure or hotel. Rather, it is a private accommodation being let solely for a self-catering holiday.
The Client further accepts that the Property does not have standards or categories recognised internationally, but instead reflects, in its architecture and furnishings, the local traditions and personal taste of the Owner.
The Client should avoid making comparisons with other properties or with standards of those in their home country.
All information and terms specific to the Property detailed on the website advertisement are incorporated in this agreement.
The Rental Period runs in units of one week between consecutive Saturdays or as stated.
Clients may enter the property at or after 4 p.m. on the commencement day of the Rental Period. Clients must vacate the property no later than 10 a.m. on the final day of the Rental Period. Arrangements can be made for early arrival by prior arrangement, but in no circumstances before 2 p.m.
This is a non-smoking property, however smoking is permitted in the garden and pool area.
To reserve the Property, an initial payment (Deposit) of twenty five percent of the holiday price is to be paid at the time of booking. The balance of the holiday price is to be paid no later than sixty days prior to the commencement of the Rental Period. If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled. For reservations made within 60 days of the start of the Rental Period, full payment is required at the time of booking. In event of cancellation, monies already paid will be returned subject to the following charges in respect of additional administration incurred and liquidated damages: Cancellation more than 60 days before the holiday 10% of holiday price Cancellation between 21 days and 60 days before the holiday 30% of holiday price Cancellation less than 21 days before the holiday 75% of holiday price · A Security Bond is required in respect of each Rental Period and shall become due 60 days before the commencement of the Rental Period.
Rental payments can be made by cheque or bank transfer in the specified currency.
The Owner will account to the Client for the Security Bond, and repayment of this Bond less any specified charges will be made within fourteen days after the final day of the Rental Period. The Bond is required in respect of breakages, damage to the property, missing items, excessive consumption of electricity, water, gas and logs, and any additional cleaning or decorating required as a result of the occupancy. The sum reserved under this Clause shall not limit the Client's liability to the Owner. Clients bringing dogs to the property must remove and dispose of any fouling by the dog. Dogs are not permitted upstairs or in the bedrooms, and must be supervised at all times.
There is an alarm system for the swimming pool, and the Client is responsible for ensuring that this is armed at all times. Children must be supervised at all times in the pool area. The pool is used entirely at the express risk of the Client.
The Property may only be occupied by the persons named on the Booking Form. Subletting is not permitted and caravans and tents may not be used. Any serious damage to the property or its contents or behaviour which is considered disruptive or unacceptable to the neighbourhood may render you liable to eviction without compensation.
The Client must permit the Owner or Owner's representative reasonable access to the Property during the rental period; whether to inspect, carry out essential repairs or for any other reasonable purpose.
The property is insured for its structure and permanent contents only. The Client is advised to take out their own comprehensive insurance for their own possessions and other aspects of their holiday.
Duvets and Pillows are provided. The supply of linen, towels and swimming towels is included. For rentals of two weeks or more, a change of linen on the middle Saturday, can be provided at a cost of €20 per person payable at the time of booking. The property is cleaned between Rental Periods. No other cleaning or maid service is included. However separate arrangements may be possible if sufficient advance notice is given. A charge is made for this, payable locally. Notwithstanding the inter-rental cleaning, Clients are asked to leave the property in a similar condition as existed at the beginning of their holiday.
The Client shall report to the Owner or his agent without delay, any defects in the Property or breakdown in the equipment, plant machinery or appliance in the Property, garden or swimming pool and arrangements for repair and/or replacement will be made as soon as possible.
Whilst it is hoped that nothing goes wrong during the holiday, the Owner shall not be liable to the Client for: - Loss, accidents or injury whilst in the house, garden or swimming pool. Loss, damage, injury or disruption, resulting from extreme weather conditions, riot, war, strikes or other matters beyond the control of the Owner. Any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the Property, garden or swimming pool. Any loss, damage, inconvenience caused or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the Rental Period and in any such event, the Owner shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the Rental Period.
Under no circumstances shall the Owner's liability to the Client exceed the amount paid to the Owner for the Rental Period. This contract shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in the EU. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England.
